Automobile/Semi-truck Crashes

Every year, hundreds of Nebraskans are killed and thousands more are injured in roadway accidents. Our firm has successfully represented accident victims and their families, and although many cases involve significant injuries, others are less severe. Insurance company adjustors are trained and paid to keep money in the pockets of their company, no matter how much they tell you they have your interests in mind. If you do not have an advocate fighting for you, they will take full advantage of your situation and insure that you are not fully and fairly compensated for your economic losses and your pain and suffering. We are here to assist with any type of vehicle injury case. Do not ever believe that your injury is not worth consideration by competent attorneys.

Wrongful Death

Many everyday accidents result in the death of a family member. The death of a loved one can be the result of many different types of accidents. Incidents involving automobiles, boats, planes, burns, trains, chemicals and medicines, medical negligence and may others can result in the wrongful death of another. In these cases the surviving family has a right to recovery for the death of the loved one. Years of experience has given Johnson & Welch, P.C. the ability to obtain compensation for the survivors of the deceased by ensuring that the full economic value of the loss is recognized. While there is no amount of compensation that can ever bring back a loved one, the recovery obtained can be used to insure the financial survival of those left behind.

Workers Compensation/Accidents at Work

Accidents occurring in the work place account for more injuries than any other type of accident. Under Nebraska law, a worker injured at his place of employment may have a valid claim for compensation. The worker may be entitled to compensation not only for medical bills, but also for short and long term disability, loss of earnings, as well as other items of loss. A law firm experienced in handling workers compensation claims will understand and appreciate which types of claims should be prosecuted and in what time frame. Johnson & Welch, P.C., has successfully represented many people who were injured while at work and offer a free consultation to review your potential claim with you.

Medical, Hospital and Nursing Home Negligence/Birth Injury

We rely on doctors and other health care professionals to make conscientious decisions regarding the treatment and care that are available. Sometimes, however, mistakes are made.

As a person injured by the negligence of a medical health professional, you have a right to fully recover for your suffering. We have experience in dealing with medical cases and holding those in the health care field responsible for improper patient care that leads to injury or death. Malpractice claims are expensive and difficult, you need to consult with a law firm with the services to properly evaluate your needs.

In nearly all medical, hospital or nursing home negligence cases, the injured patient/resident must prove his or her case through a medical expert who testifies that the treating healthcare provider acted improperly, negligently or unreasonably - that the healthcare provider did not act within the standard of care which applies to that professional.

Because expert proof is an absolute must for most health care negligence claims, it is important to be represented by an attorney who can select and retain the necessary experts, whether they are surgeons, neurologists, cardiologists, pediatricians, nurses, emergency room doctors, or other healthcare professionals. We have retained experts from a multitude of medical specialties to assist us in meeting our clients burden of proof and thus recover for the traumatic injuries they have suffered.

Medical expert fees are expensive as are other costs associated with bringing medical negligence lawsuits. It is important to note that while the client is ultimately responsible for the expenses of litigation, including court costs, expenses of investigation and the costs of obtaining and presenting expert testimony. We advance most of the expenses to get your case the attention it deserves. Once your case is concluded, these costs are deducted from the total amount recovered.

Brain and Spinal Cord Injuries

Johnson & Welch, P.C. has invested considerable time in the preparation and litigation of complex head injury and spinal cord injuries and has an on staff paralegal who is a board member for the Nebraska Brain Injury Association. These injuries change victims lives completely and it takes a qualified attorney to put together a team of professionals skilled at addressing the needs of those who have suffered catastrophic injuries.

Because spinal cord and brain injury cases are expensive and emotionally difficult at times, it is important that you consult a law office with the experience, training and compassion to carefully evaluate, investigate and prosecute your case. We at Johnson & Welch, P.C. work very hard to evaluate cases thoroughly from the very beginning in order to keep our clients from starting on a futile effort, and aggressively pursue all of our clients' cases.

Scarring/Animal Attacks

One of the most common injuries involves the violent attack by dogs or other pets upon innocent victims. The incidence of dog bites among children is especially high and must be approached with special diligence. As in other categories of personal injury law, there is no substitute for an experienced lawyer to make sure that you or your loved one is fairly and fully compensated for an attack by someone else's dog or other pet.

Slip & Fall Injuries

Slip and fall cases are all too common, especially in our Midwestern climate. This is the type of incident which has happened to us all and can occur anywhere. The facts of a slip or trip and fall case are critical. How it happened; where it happened; what made it happen; the time of day; the weather; the lighting; the type of surface and the condition of the surface; the type of footwear and clothing worn; witnesses (before, during and after). Did the injured person have notice of the condition that caused the slip or trip and fall? Was the injured person comparatively negligent for the injury? These items and others can all play key roles in determining the value of a slip or trip and fall case, including whether there is a case at all. Johnson & Welch, P.C. has evaluated and represented victims in hundreds of slip or trip and fall cases.

Dangerous Products

Johnson & Welch, P.C., is committed to holding negligent companies responsible for dangerous or faulty products. Such cases can involve products ranging from complex industrial and farm equipment, automobiles, motorcycles, all-terrain vehicles, to common household goods such as propane tanks and gas grills, appliances, batteries, and cleaning solutions. It is very important to realize that the manufacturer of any unsafe product is usually reluctant to admit its responsibility and, therefore, the preparation of these cases almost always requires expert testimony. We are skilled at selecting and preparing the appropriate experts to help establish liability for dangerous or faulty products
